2. Data protection at a glance

In accordance with Articles 13 and 14 of the General Data Protection Regulation (GDPR), this privacy policy informs you which personal data we process when you visit this website, for what purposes, on what legal basis and for how long. Personal data is any information that can be used to identify you personally, for example your name, e-mail address, phone number or IP address.

We only process your data where this is necessary to provide the website, handle your enquiries, prepare and perform contracts or – with your consent – for statistics and marketing. We do not sell your data.

3. Legal bases

We base the processing on the following legal bases:

  • Art. 6(1)(a) GDPR: your consent.

  • Art. 6(1)(b) GDPR: performance of a contract or pre-contractual measures, e.g. for transport enquiries and quotes.

  • Art. 6(1)(c) GDPR: compliance with legal obligations, e.g. retention obligations under commercial and tax law.

  • Art. 6(1)(f) GDPR: legitimate interests, e.g. the secure and stable operation of the website.

  • § 25(1) TDDDG (German Telecommunications Digital Services Data Protection Act): consent to storing information on your device or accessing it (e.g. cookies). Strictly necessary cookies are used without consent on the basis of § 25(2) no. 2 TDDDG.

You can withdraw any consent you have given at any time with effect for the future. The lawfulness of processing carried out before the withdrawal remains unaffected.

4. Hosting and provision of the website (Wix)

This website is built with the Wix website builder and hosted on its servers. The provider is Wix.com Ltd., 40 Namal Tel Aviv St., Tel Aviv 6350671, Israel ("Wix").

When you access the website, Wix automatically processes technical data transmitted by your browser (server log files): IP address, date and time of access, page accessed, referrer URL, browser type and version, operating system. This data is required to deliver the website, for stability and IT security, including the detection of technical errors. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in the secure and error-free presentation of our website.

The European Commission has adopted an adequacy decision for Israel, so its level of data protection is considered equivalent. Wix also uses sub-processors, including in the USA. Transfers to the USA are based on the EU-US Data Privacy Framework (DPF) where the recipient is certified, or on the European Commission's standard contractual clauses.

We have concluded a data processing agreement with Wix pursuant to Art. 28 GDPR. Further information: https://de.wix.com/about/privacy

5. Cookies and consent banner

This website uses cookies. These are small text files stored on your device. We use technically necessary cookies (e.g. for security, session management, language settings and saving your cookie choice) without consent (§ 25(2) no. 2 TDDDG, Art. 6(1)(f) GDPR).

We only use all other cookies and similar technologies – for statistics, convenience functions and marketing – if you consent via our cookie banner (§ 25(1) TDDDG, Art. 6(1)(a) GDPR). The banner is provided by Wix and saves your choice in the "consent-policy" cookie so that the banner does not reappear on every page view.

You can change or withdraw your consent at any time by reopening the cookie settings or deleting the cookies in your browser. The banner will then appear again on your next visit.

6. Contact form, e-mail, phone and fax

If you contact us via the contact form, by e-mail, phone or fax, we process your details (e.g. name, e-mail address, phone number, subject and message) in order to answer your enquiry. The contact form is provided via Wix; the entries are stored in our Wix account (see section 4).

The legal basis is Art. 6(1)(b) GDPR if your enquiry relates to a contract or a quote, and otherwise Art. 6(1)(f) GDPR (our interest in answering enquiries).

We delete your enquiry once it has been fully dealt with, unless statutory retention obligations apply. We retain business letters and quote-related documents for six or eight to ten years in accordance with § 257 HGB (German Commercial Code) and § 147 AO (German Fiscal Code).

7. Request assistant and vehicle finder

On the home page we offer a request assistant and a vehicle finder. Your entries (e.g. loading place, destination, goods, weight, date) are evaluated exclusively locally in your browser according to fixed rules. No artificial intelligence is used, and no data is transmitted to or stored by us or third parties in the process.

Only when you click "Send request" does your own e-mail program open with a pre-filled message to info@serkali.com containing your name, your e-mail address, optionally your phone number and the request details. You decide whether to send this e-mail. Section 6 applies to the processing of the e-mail.

8. Job applications

On the careers page you can apply to us using a form or by e-mail. We process your details (e.g. first and last name, e-mail address, message and any documents sent) exclusively to carry out the application process.

The legal basis is Art. 6(1)(b) GDPR (initiation of an employment relationship) and § 26 BDSG (German Federal Data Protection Act), where applicable. We process voluntary information on the basis of your consent (Art. 6(1)(a) GDPR).

If an employment or contractual relationship is established, we transfer the data to the personnel file. Otherwise, we delete your application data no later than six months after the end of the process so that we can defend ourselves against possible claims under the German General Equal Treatment Act (AGG) (Art. 6(1)(f) GDPR). Longer storage only takes place with your consent.

9. Chat functions

Wix Chat

You can send us messages directly via the chat window. The chat is provided by Wix (see section 4). We process the contact details you provide and the content of your message in order to answer your enquiry. The legal basis is Art. 6(1)(b) GDPR for contract-related enquiries, otherwise Art. 6(1)(f) GDPR. We delete chat histories as soon as they are no longer needed, unless retention obligations apply.

10. Newsletter

If you subscribe to our newsletter, we process your e-mail address to send you information about our services. The newsletter is sent via Wix e-mail marketing (see section 4). The legal basis is your consent (Art. 6(1)(a) GDPR, § 7(2) no. 3 UWG (German Act Against Unfair Competition)).

You can unsubscribe at any time via the unsubscribe link in every e-mail or by writing to info@serkali.com. After unsubscribing, we remove your e-mail address from the mailing list; to prove earlier consent, we may keep it on a block list for up to three years (Art. 6(1)(f) GDPR).

11. Google Maps

Our contact page does not embed a Google map. Instead, it contains a link "Open route in Google Maps". Only when you click this link does Google Maps open in a new window and your data (e.g. IP address) is transferred to Google. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"); data may also be transferred to servers of Google LLC in the USA. Google itself is responsible for processing on the Google website.

Google is certified under the EU-US Data Privacy Framework. Further information: https://policies.google.com/privacy

12. Web analytics and statistics

Google Analytics 4

Only if you consent to statistics or marketing in the cookie banner do we use Google Analytics 4 from Google Ireland Limited (address see section 11). Google Analytics sets cookies (e.g. "_ga", "_ga_*") and creates pseudonymous usage profiles to evaluate the use of our website, e.g. pages viewed, time spent, approximate origin and device used. Google Analytics 4 does not store IP addresses. Data may be transferred to Google LLC in the USA; Google is certified under the EU-US Data Privacy Framework.

The legal basis is your consent (Art. 6(1)(a) GDPR, § 25(1) TDDDG). The cookies are deleted after 24 months at the latest. Google's data processing terms apply. Further information: https://support.google.com/analytics/answer/6004245

13. Google Ads and conversion tracking

We advertise with Google Ads (provider: Google Ireland Limited, address see section 11). To measure the success of our ads, we use Google Ads conversion tracking once ads are running – exclusively if you consent to marketing in the cookie banner. A cookie is set when you reach our website via a Google ad, and it is recorded whether you then carry out an action (e.g. send a request). We only receive statistical reports, no information that identifies you personally. If you are logged in to Google, Google can link the data to your Google account.

We use Google Consent Mode: without your consent, no advertising cookies are set. The legal basis is your consent (Art. 6(1)(a) GDPR, § 25(1) TDDDG). Transfers to Google LLC in the USA are based on the EU-US Data Privacy Framework. Further information: https://business.safety.google/privacy/

14. Recipients and transfers to third countries

Your data is only received by parties who need it for the purposes stated: our employees, the service providers named in this policy (as processors with a contract pursuant to Art. 28 GDPR) and – where required by law – authorities, e.g. tax authorities. For transport orders, we pass on the necessary data to the carriers and subcontractors involved (Art. 6(1)(b) GDPR).

Transfers to countries outside the EU/EEA only take place if there is an adequacy decision by the European Commission (e.g. Israel or the EU-US Data Privacy Framework for certified US companies) or appropriate safeguards such as standard contractual clauses have been agreed.

15. Storage period

We only store personal data for as long as is necessary for the respective purpose. The specific periods are given in the individual sections. Where statutory retention obligations exist, we restrict processing until these periods expire and then delete the data.

16. Your rights

Under the GDPR you have the following rights:

  • Access to your stored data (Art. 15 GDPR)

  • Rectification of inaccurate data (Art. 16 GDPR)

  • Erasure of your data (Art. 17 GDPR)

  • Restriction of processing (Art. 18 GDPR)

  • Data portability (Art. 20 GDPR)

  • Objection to processing (Art. 21 GDPR)

  • Withdrawal of consent with effect for the future (Art. 7(3) GDPR)

To do so, simply contact info@serkali.com.

You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is: Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg, Heilbronner Straße 35, 70191 Stuttgart, Germany, https://www.baden-wuerttemberg.datenschutz.de

17. Right to object under Art. 21 GDPR

If we process your data on the basis of legitimate interests (Art. 6(1)(f) GDPR), you can object to this processing at any time on grounds relating to your particular situation. We will then no longer process your data unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing serves to establish, exercise or defend legal claims.

If we process your data for direct marketing, you can object to this at any time without giving reasons. We will then no longer use your data for this purpose.

18. Data security

For security reasons, this website uses SSL/TLS encryption. You can recognise an encrypted connection by "https://" in the address bar and the lock symbol in your browser. Please note that unencrypted e-mails can be read by third parties in transit.

19. Obligation to provide data and automated decisions

You are not obliged to provide us with personal data. However, without certain information (e.g. a way to contact you) we cannot process your enquiry or application. No automated decision-making, including profiling, within the meaning of Art. 22 GDPR takes place.

20. Changes to this privacy policy

We update this privacy policy when our website, the services we use or the legal situation change. The version published here applies.
